U-Feast Corporation (hereafter referred to as “U-Feast”) provides an online platform that connects chefs, restaurants and wineries who wish to host food and wine events with buyers seeking to purchase tickets to such events (an “Event” or collectively the “Events”), which Events are accessible at www.ufeast.com and any other websites or mobile applications through which U-Feast may make such Events and information available (collectively, the “Site”). By becoming a Member of U-Feast, purchasing a ticket to an Event, and/or attending a U-Feast Event as a Member or non-member guest (hereafter collectively referred to as a “Membership”) you hereby agree to comply with and be legally bound by the following terms and conditions of these Terms of Use.

Terms of Use:

In consideration of receiving a Membership or by receiving the rights and privileges of Membership by attending an Event as non-member guest, I hereby release, forever, waive and discharge U-Feast, its officers, agents, contractors, employees, successors, subsidiaries, or assigns (hereinafter referred to as “Releases”) from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to any losses, damages, or injuries, including death, that may be sustained by me, by any third parties or to any of the property belonging to me, whether caused by the negligence of the Releases, or otherwise, arising out of or connected to the Site, my Membership or an Event.

I am fully aware of the risks involved and the hazards connected with my Membership and attending U-Feast Events, including without limitation, the entering upon certain properties or venues that may contain hazards or risks, the risk of eating food that may be prepared outside of a traditional restaurant setting, and participating in or attending an Event, including but not limited to the risk of injury to myself, my property, my invitees, guests, and third parties, and I hereby elect to voluntarily participate in said activities through my Membership with full knowledge that said activities may be hazardous to myself and my property. I VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ANY RISKS OF LOSS, PROPERTY DAMAGE OR PERSONAL INJURY, INCLUDING DEATH, that may be sustained by me, my invitees, guests or agents, or any loss or damage to property owned by me, my invitees, guests or agents, as a result of being engaged in such an activity whether caused by the negligence of the Releases or otherwise.
I further hereby AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS the Releases from any losses, liabilities, damages, claims, demands, liabilities, liens, debts, rights of action or costs, including court costs and legal fees, with respect to, arising out of, or in any way related to my or my invitee’s or agent’s entry on a property for the purpose of participation in an Event or any related activity, whether caused by negligence of Releases or otherwise.

I understand that U-Feast’s insurance policies may not cover any circumstance arising from my Membership or participation in an Event or any activity associated with either.
I acknowledge and understand that U-Feast and its sponsors, vendors and partners may from time to time take photos and/or videos at U-Feast Events, and later use them for promotional or marketing purposes. By participating in or attending any U-Feast Event, I hereby agree that U-Feast may take these photos and videos, and I authorize their use in this fashion and hereby grant U-Feast and its licensed vendors and partners permission to photograph and/or record myself and my invited guests at an Event, and to distribute (both now and in the future) the attendee’s image or voice in photographs, videotapes, electronic reproductions, and audiotapes of such events and activities.

It is my express intent that this Term of Use Agreement shall bind my heirs, successors, administrators and assigns and shall be deemed as a release, waiver, discharge and covenant not to pursue legal action against the Releases. I hereby further agree that this Term of Use Agreement shall be governed by the laws of the Province of Ontario, Canada. If one or more provisions of this Agreement are held to be unenforceable under applicable law, then such provision(s) shall be excluded from this Agreement to the extent they are held to be unenforceable and the remainder of the Agreement shall be interpreted as if such provision(s) were so excluded and shall be enforceable in accordance with its terms.

I confirm and acknowledge that I have read the foregoing Terms of Use, understand them and voluntarily agree to them and that no oral representations, statements, or inducements, apart from the foregoing written agreement, have been made. I also confirm that I am at least nineteen (19) years of age and fully competent; and I execute this agreement for full, adequate and complete consideration fully intending to be bound by same.

Privacy Policy

This Privacy Policy governs the use of the U-Feast website (the “Site”) and related services provided by U-Feast, and its subsidiaries and affiliates (collectively “U-Feast”), including the manner in which U-Feast treats personal information that it collects and receives through the Site or at Events. Pursuant to U-Feast’s Terms of Use Agreement, you must be 19 years of age or older to use the Site or attend Events. Therefore, this policy makes no provision for individuals under the age of 19.

1. Information Collected

U-Feast collects information from you when you register on the Site, fill out your Member application, buy a ticket to an event, enter into a contest or promotion while at an Event, or when you respond to a survey or other communications such as e-mail (the “Collected Information”). When registering as a Member or when purchasing a ticket to an Event, we may ask you for your name, e-mail address, mailing address, phone number, credit card information or other information related to the purchase of a ticket including dietary preferences or restrictions.

2. How We Use Your Information

We may use the Collected Information in the following ways:

  • To personalize your Site experience and to allow us to deliver the type of content and product offerings in which you are most interested including geo-targeting content for you
  • To allow us to better service you in responding to your customer service requests
  • To process your ticket purchasing transactions
  • To administer an event, dinner, contest, promotion, survey or other Site feature
  • Provided you have opted in when signing up as a member or opted in to our mailing list, we will provide you with news and information about U-Feast either through periodic emails or via subscription to the U-Feast blog. If you would no longer like to receive e-mails from us and would like to withdraw your consent, please use the “Opt-out” features described below. Once you opt-out from receiving e-mail newsletters or the blog subscription, you will no longer receive this information.

3. How We Protect Your Information

We implement a variety of security measures to maintain the safety of your personal information. Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights authorized by U-Feast management to such systems. All persons who have access to this information are required to keep the information confidential. When you buy tickets or when we access your personal information, we use a secure server. All personal information you supply is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our databases to be only accessed as stated above. However, please note that we do not keep your credit card information on file or in any database. This information is only stored by our payment processing partner Stripe in their databases in a secure manner. This is to ensure the safety and privacy of your credit card information.

4. Use of "Cookies"

Like many websites, we use “cookies” to enhance your experience and gather information about visitors and visits to our Site. Cookies are small files that a site or its service provider transfers to your computer’s hard drive through your Web browser that enables the Site’s or service provider’s systems to recognize your browser and capture and remember certain information. For instance, we use cookies to help us remember and process the items in your shopping cart or the city that you live in. They are also used to help us understand your preferences based on previous or current Site activity, which enables us to provide you with improved services. We also use cookies to help us compile aggregate data about Site traffic and Site interaction so that we can offer better experiences and tools in the future. We may contract with third-party service providers to assist us in better understanding our Site visitors. These service providers are not permitted to use the information collected on our behalf except to help us conduct and improve our business. You can choose to have your computer warn you each time a cookie is being sent, or you can choose to turn off all cookies. You do this through your web browser settings. If you turn cookies off, you won’t have access to many features that make your Site experience more efficient and some of our services will not function properly. However, you can still place orders over the telephone by contacting customer service at support@ufeast.com.

5. Information Disclosed To Third Parties

We do not sell, trade, or otherwise transfer to third parties your personally identifiable information unless we provide you with advance notice, except as described below. The term “third parties” does not include U-Feast event partners, vendors and suppliers. It also does not include website hosting partners and other service providers who assist us in operating the Site, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. We may also release your information when we believe release is appropriate to comply with the law, enforce our Site policies, or protect ours or others’ rights, property, or safety. Non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses.

6. Opting-out, Removing Or Modifying Your Information

Your user account information and password can easily be modified by accessing your member Account on our Site. To opt-out from receiving further email communications or from your subscription to the U-Feast blog, just click on the “Unsubscribe” button at the bottom of the page of our blog or our newsletter. To delete all of your online account information from our databases, please email support@ufeast.com or speak to a customer service representative at 1-800-263-6042.

7. Privacy Policy For This Site Only

This online privacy policy applies only to information collected through our Site and not to information collected offline or via third party links to other sites.

8. Consent

By using our Site, you hereby agree to all of the terms and conditions contained in this privacy policy.
